1.1 Introduction. These general terms and conditions defined in this text as "Terms and Conditions" regulate the usage of games and play provided through simplecasino.com, which are managed by Hero Gaming Limited (the "website"). If you are betting on sports, these terms apply in addition to the General Terms and Conditions.
1.2 Your acceptance. You must read and understand these Terms and Conditions fully before using the Website. If you do not agree with any part of these Terms and Conditions, you are not allowed to use or continue to use the Website. These Terms and Conditions become applicable when you register at the Website. By continuing to use the Website, you signify that you agree with these Terms and Conditions as updated from time to time.
1.3 About us. Hero Gaming Ltd is a company incorporated in Malta with registration number C61794, having its registered address at Level 0, Spinola Park, Triq Mikiel Ang Borg, SPK 1000, Malta. Hero Gaming Ltd is in these Terms and Conditions referred to as “Simple Casino”,“we” or “us” and you, as an individual using the Website, as “you” or the ”Player”.
1.4 Our license. Hero Gaming Ltd is licensed and regulated in Malta by the Maltese Gaming Authority, under Corporate Group Gaming Service License number MGA/CRP/253/2013. Our license was last renewed on May 23, 2019. We offer Type 1 and Type 2 gaming services. Games available on the Website are provided by a number of different game providers, which are licensed and regulated by the MGA.
1.5 Changes to these Terms and Conditions. The current version of these Terms and Conditions is valid until a new version is available on the Website. We reserve the right to modify these Terms and Conditions. You will be notified in advance when material changes to the Terms and Conditions occur and you will need to accept these changes before they become binding to both you and us. Should you not accept the changes to the Terms and Conditions you may not be able to log in to your account and if you have a positive balance on your account, you can contact us on [email protected] or through chat in order to withdraw it.
1.6 Languages. These Terms and Conditions may be published in several languages, reflecting the same principles, for information purposes, and to help Players. In case of any discrepancy between the English version and the non-English version of these Terms and Conditions, the version more favorable to you shall prevail.
1.7 Game Rules. The Games available on the Website have different rules, which can be found in the actual Game, and you must always play the Games in line with any special rules that apply to each Game. You will also find generic rules for different types of games on the Website.
2.1 Your age. You confirm that you are over 18 years or such higher age that may apply under the laws in the jurisdiction of your residence. It is your sole responsibility to know the age at which gambling is legal in your country of residence.
2.2 Personal entertainment. You may participate in the Games strictly in your personal non-professional capacity, on your own behalf and not on the behalf of any other person or company. You may only participate in the Games for recreation and entertainment purposes, in accordance with these Terms and Conditions, together with all applicable laws, rules, and regulations. Any participation in the Games by a corporate player or for commercial purposes is prohibited unless we have entered into a separate written agreement for such purpose.
2.3. Gambling problems. You may not participate in the Games if you are a problem gambler, has self-excluded or closed yourself from any of our other brands (caused by gambling problems), and/or if you are included (whether voluntarily or involuntarily) in any register or database of players with gambling issues.
2.4 Legality. Gambling may be illegal in the country in which you are located or residing. Our intention is not to enable you to contravene any laws applicable. You are responsible for ensuring that you are permitted to play the Games in the country you are accessing them from. We prohibit access for persons located temporarily or persistently in, or residents of, certain jurisdictions. 2.5 Correct information. You confirm that all information that you give us is complete, true, correct, and that you will immediately notify us changes of such information or change such details yourself on the Website.
2.6 Taxes. You are solely responsible for reporting and accounting for any taxes or other fees applicable to you under the relevant laws for any winnings that you receive from us.
2.7 Risk of losing. You understand that by playing Games provided by us, you take the risk of losing money deposited into your account.
2.8 Illegal activities. You shall not be involved in any fraudulent, collusive, fixing or other unlawful activity in relation to your or third parties’ participation in any of the Games and shall not use any software-assisted methods or techniques or hardware devices for your participation in any of the Games. You may not use funds that are associated with any illegality or originate from any illegal activity or source. You may not sell, transfer and/or acquire accounts to/from other players.
3.1 Opening your account. For you to be able to participate in the Games, you must first register and open an account with us. As part of the registration process, you will choose your username and password, and any other requested information for your successful login into the Website. You must enter all mandatory information requested into your registration form all of which must be true and correct.
3.2 Account security. It is your sole and exclusive responsibility to ensure that your login details are kept secure. You must not disclose your login details to anyone. We are not responsible for any abuse or misuse of your account by third parties due to your disclosure, whether intentional or accidental, whether active or passive, of your login details to any third party. In case there is suspicion that such information should have been compromised you must inform us and take proper actions to prohibit or prevent any unauthorised access to any part of your account or funds. You are not allowed to transfer funds from your account to any other person, receive money from other persons into your account, or to transfer, sell and/or acquire, user accounts.
3.3 Duplicate Accounts. You may only hold one account with us at any single point in time. We reserve the right to close any multiple accounts opened in the same name or in any way referable to the same person. If you notice that you have more than one registered account, you must notify us immediately. Failure to do so may lead to your account being blocked for access. In our sole discretion and if we consider that multiple accounts have been opened in genuine error, we may agree to credit one account which you have opened with us with any balance remaining on your additional account(s). Should we have grounds to believe that fraud has been committed or attempted (including opening more than one account in order to claim additional bonuses or benefits), we reserve the right to cancel any related transaction, any bonus or any other promotion without prejudice to any other action.
3.4 Customer Due Diligence and Duty of Care. In order for us to fulfill our legal obligations we may ask you for information in addition to the registration details when you apply for an account and at any time while you hold an account with us. This could include, but is not limited to, proof of your identity, address, age, origin of funds deposited, utility bills and bank statements. We may also obtain information about you through publicly available sources and databases. We will always request additional documents if your cumulative deposits, or a withdrawal request, reaches EUR 2,000 but documentation may be requested at lower levels. We may block your account at our discretion at any time if we are not satisfied with the information with which you have supplied us or in the event that there is delay in supplying the requested information. Failure to provide correct information or to provide any information requested to enable us to comply with our legal obligations may result in you being reported to the relevant regulatory body. This may include criminal and serious crime monitoring/reporting agencies. Please note that we may be restricted by law from informing you about such reporting.
4.1 Available methods. Available deposit and withdrawal options are listed on the Website and may differ from time to time depending on the jurisdiction of the Player. To the extent possible, all withdrawals must be done through the same payment method chosen by you when placing a deposit. You shall only use credit cards and other financial instruments that are valid and lawfully belong to you for deposits and withdrawals. You may not use company credit cards to deposit on the Website.
4.2 Fees. We may charge fees for processing deposits and withdrawals. If such fees apply, they will be clearly communicated during the deposit process. Deposits made to your account should be used for playing the Games. If there is suspicion of abuse, for instance where a deposited amount has not been used for an appropriate level of Game play and the Player then makes a withdrawal request in relation to that deposited amount or where we suspect that you are abusing exchange rate fluctuations, we reserve the right in our absolute discretion to cancel the respective deposit(s) in part or in full and to retract any associated costs.
4.3 Minimum and Maximum Levels. We may assign minimum deposit levels and maximum deposit levels as specified on the Website.
4.4 Processing Time. The time it takes between making a deposit and availability of the deposited funds in the account as well the time it takes between requesting a withdrawal and availability of the withdrawn funds in your account, may vary depending on the payment method used. A withdrawal attempt should generally be approved or denied within a reasonable time. However, withdrawals may be delayed as a consequence of our legal obligations to request additional documentation and information from you. If you win and decide to withdraw €20,000 or more over a period of 30 days or less, we reserve the right to pay out your winning in instalments over time. We further reserve the right to limit withdrawals to €5000 per day.
4.5 Incorrect credits. If we mistakenly credit your account with winnings that do not belong to you, whether due to a technical or human error or otherwise, the amount will remain our property and the amount will be transferred from your account as soon as possible. If, prior to us becoming aware of the error, you have withdrawn funds that do not belong to you, without prejudice to other remedies and actions that may be available at law, the mistakenly paid amount will constitute a debt owed by you to us. In the event of an incorrect crediting, you are obliged to notify us immediately.
4.6 Currency and interest. We accept deposits made EURO. If your payment account (such as your bank account or your eWallet-account) has a different currency than EURO, we’ll convert the funds to EURO before depositing them to your account. Likewise, the funds you withdraw will be sent to you in EUR and your bank/eWallet, as the case may be, will convert the funds to your payment account currency. Please note that any exchange costs are payable by you. Funds held in your account do not generate interest.
4.7 No returns or refunds. Our products and services are consumed instantly. Thus, we cannot provide refunds, returns of goods, or cancellation of the service when playing. If you play a Game with real money, the money will be drawn from your account instantly.
4.8 Agents. Please note that we may authorise commercial agents to process any deposits or withdrawals on our behalf.
5.1 Separate terms. Individual bonus campaigns can have specific details and terms, in this case such information shall be made available to the Player separately. In absence of such terms, the provisions in this clause shall apply.
5.2 Lapse of bonus money. We reserve the right to withhold and remove any bonus money awarded to you if it has not been used within 60 days from the date awarded. Individual campaigns may have a shorter expiration time and are, if so, this is stated to the Player related to the time when receiving the campaign offer.
5.3 Wagering requirements. Upon depositing to receive bonus funds or Free Spins, you must wager your deposit at least once. If you are eligible for a bonus or free spins, wagering requirements will apply before you are eligible to make any cash-outs of the bonus or winnings by bets using bonus money. If you would like to request a withdrawal before the wagering requirements are fulfilled, we will deduct the whole bonus amount as well as any winnings made from bonus money before approving any withdrawal. We have the right to choose which Games, and how much a Game, contributes to the wagering requirements. Winnings from Free Spins (rounds) have a wagering requirement of forty (40) times the winning sum if nothing else is stated alongside the Free Spin campaign to contradict this. Only bets with bonus money count towards the wagering requirements. If no specific information is given regarding wagering requirements when receiving a bonus, the wagering requirement is set to forty (40) times the sum of the received bonus amount. Local wagering requirements may be applied and if so, are to be stated together with the offer. Risk-free bets on any Games do not qualify for wagering requirements.

5.4 Individual bonuses. Bonuses/Free Spins on the Website can only be received once per household, IP address and/or credit card number.
5.5 Bets and wins with bonus money and frees spins. Winnings generated from Free Spins become bonus money and these count towards wagering requirements. During gameplay, real money is used first. Real money bets give real money winnings and mixed bets or bonus money only bets give bonus money winnings. When placing a bet of bonus money or a bet containing bonus money, wagering is decreased with the amount of the bonus bet and at a maximum of €5. Maximum allowed bet containing bonus money is €5, winnings due to higher bets may be removed. Bonus money cannot be withdrawn.
5.6 Unfinished game rounds. Game rounds and game features triggered with bonus funds must be played through whilst a bonus is active. You are not permitted to delay completion of game rounds or game features until after the wagering requirement for that bonus has been met, and/or you have deposited new funds. If such activity is identified, your bonus and/or any associated winnings may be voided.
5.7 Simple Casino reserves the right to close your account and not to issue refunds of any deposits, remittance of balances or winnings generated on the account, should we suspect bonus abuse has occurred. Abuse includes but is not limited to, cash stashing, bonus stashing, or else by depositing only to receive free spins and withdrawing your real money before wagering the amount deposited at least once.
6.1 An inactive account is an account that has not been accessed for 12 months, that has a real money balance. If your account has become inactive without us notifying you, we may close your account and reimburse any remaining balance to you by remitting the balance directly to your bank account via bank transfer. If we notify you at least thirty (30) days before your account is due to become inactive and you do not withdraw the remaining funds, we may elect to charge a fee for inactivity or to close your account. Fees may only be charged to an inactive account as long as that account does not go into a negative balance. Where we elect to charge an inactivity fee, such fee shall be a monthly administrative fee of €5 or the equivalent in any other currency.
7.1 Limits. You may at your discretion choose to limit the amount you are allowed to deposit (withdrawals increases the allowed deposit amount) during a day (00:00-23:59 CET), week (Monday-Sunday) or monthly (first - end of calendar month, or from the time of activation until end of month when limit is set). If you reach this limit for how much you deposit (with consideration also to withdrawals during the period), you will not be able to deposit more money. All limits are administrated and initiated by contacting the Website support, through ‘My Account’ or email/chat. When a limit is set for the first time, it will immediately come to affect once it has been registered. If you wish to decrease a limit set, such change will take place immediately once registered. If you wish to remove or increase a limit set, such change shall only take place 24 hours after the request has been registered. Please note that limits apply per website and not per license holder / company.
7.2 Self-exclusion. You may at your discretion choose to limit your ability to access your account for an indefinite time (indefinite self-exclusion) or a specified time (definite self-exclusion). Self-exclusions shall immediately become effective upon notification to our support. An self-exclusion request is valid for the Website you are currently playing on only and does not include other sites operated by the same company. With an indefinite self-exclusion, your account will not be accessible again and your remaining funds are transferred back to your bank account. If you wish to remove an indefinite self-exclusion such change shall take place 7 days after our support receives such request. If you wish to increase the duration of a definite self-exclusion, such increase shall be effective immediately. If you wish to decrease the duration of a definite self-exclusion, such decrease shall generally be effective 24 hours after our support receives such request. We may at our discretion and for whatever reason (including but not limited to gambling problem concerns or security concerns) refuse to re-open an account after a self-exclusion.
9.1 We are the sole owner of the trademark Simple Casino and the Simple Casino logo. Any unauthorised use of the Simple Casino trademark and the Simple Casino logo may result in prosecution. The Website and any other subdomains belong to us or our group companies and no unauthorised use is allowed to be made of the URL. We are the owner or the rightful licensee of the rights to the technology, software and business systems used within the Website. The contents and structure of the Website pages are subject to copyright and database right. All rights are reserved. The copyright in the Website including all text, graphics, code, files and links belongs to us and the Website may not be reproduced, transmitted or stored in whole or in part without our written consent. Your registration and use of the Website does not confer any rights whatsoever to the intellectual property contained in the Website.
10.1 Unexpected technical problems or circumstances outside of our control may require that we cancel and refund bets to you. Such circumstances could include but are not limited to technical problems with a Game and/or where that a game is “stuck” in a state where a game round is not being finished. Similarly, your account balances may have to be adjusted under certain circumstances, including but not limited to if a bonus campaign has in any way been misconfigured or if a Game malfunctions. If there is a malfunction in a Game or its interoperability, any bets made during such malfunctioning shall be void. Winnings obtained from a malfunctioning Game shall be considered void, as well as any subsequent game rounds with said funds, regardless of what Games are played using such funds.
11.1 Complaints to customer service. We hope you enjoy our Website and do our best to provide you with a great service. 11.2 Tending to your complaint. We aim to provide you with a substantial response to your complaint as soon as practically possible and seek to resolve your complaint within ten days from the date we receive the complaint. Depending on the complexity of the complaint, our investigation may take longer than ten days to resolve. We will ensure that we write to you within ten days of the date we receive your complaint with either a final response or an update of the position explaining why we are not in a position to provide a final response, and when we expect to be able to do so.
11.3 Complaints to Alternative Dispute Resolution. Once we have reviewed the details of the complaint and confirmed our final response by email, this effectively ends our internal complaints procedure. Players who remain dissatisfied with our final reply have the right to refer the dispute to our Alternative Dispute Resolution (ADR) service, which is held by eCogra, 6, Villa Gauci, Mdina Road, Balzan, BZN9031, Malta. 11.4 Complaints to Malta Gaming Authority. Complaints relating to the provision of the gaming service by us, i.e. reports relating to our services not being safe, fair, or transparent, may be referred to the Malta Gaming Authority Player Support Unit, either through the MGA’s website (https://www.mga.org.mt/support/online-gaming-support/) or by sending an email on [email protected]
12.1 No warranty. You use the Website and participate in the Games at your own risk. The Website and the Games are provided without any warranty whatsoever, whether expressed or implied. 12.2 No Liability. 13.1 Your account closure. If you wish to close your account, you may do so at any time, by contacting customer support in written form. If you are closing your account for gambling addiction concerns and you want us to consider those issues in the future, you must indicate this as the reason behind the closure to make us aware. We will promptly transfer all funds from your account (subject to the deduction of relevant withdrawal charges) to payment options available in your country. 13.2 Our Account closure. We may terminate your account at any time at our sole discretion. Below are some examples of circumstances where we may decide to suspend or terminate your account and/or, in certain circumstances, withhold payment of your winnings:
13.2.1 If you breach any provision of these Terms and Conditions or we have a reasonable ground to suspect that you have breached them.
13.2.2 If you are or we suspect that you are engaged in illegal and/or fraudulent/abusing activities when using the Website.
13.2.3 If we consider that your continued use of our services is detrimental to your health and wellbeing.
13.2.4 If you are having problems with creditors or your use of or Website otherwise is detrimental to our business.
13.3 Account Closure Fee. Depending on the payment type you use, the withdrawal of your funds may be subject to withdrawal or administrative fees. Please note that administration fees of low value withdrawals often exceed the amount of the withdrawal and therefore where a final withdrawal amount upon account closure is less than €10, we will not refund this, and it will instead be charged as an account closure fee.
14.1 If any provision of these Terms and Conditions is held to be illegal or unenforceable, such provision shall be severed from these Terms and Conditions and all other provisions shall remain in force unaffected by such severance.
15.1 We reserve the right to assign or otherwise lawfully transfer our rights and obligations under these Terms and Conditions. You shall not assign or otherwise transfer your rights and obligations under these Terms and Conditions.
17.1 These Terms and Conditions shall be governed by the Laws of Malta. The parties agree that any dispute, controversy or claim arising out of or in connection with these Terms and Conditions, or the breach, termination or invalidity thereof, shall be submitted to the exclusive jurisdiction of the Maltese courts.
